Are you wondering whether or not you can modify a child support agreement? Here at the Law Offices of Jorge L. Gonzalez, P.A., our team of legal professionals are here to make sure you get the information you need. If you are in need of a modification, we are here to make sure you get it. Our paternity lawyer is located in Doral, FL.
It Is Time To Modify
Child support is always modifiable under Florida child support law, as long as the change would be at least $50 or 15% – whichever is greater. This includes prior orders for child support under a previous divorce, paternity case, or any support order established by the Florida Dept. of Revenue Child Support Enforcement Office. You can never designate child support as unmodifiable. Any time a parent establishes the basic requirements for modification, that parent may file a petition for modification of child support.
When and how to modify child support, time-sharing, and alimony are questions that many parents find so confusing that they end up doing nothing about their changed financial circumstances. This can be a big mistake and can wind up costing you a lot of money.
Child support, alimony, and time-sharing cannot be modified on a whim. A judge can only modify a prior order establishing time-sharing, alimony payments and child support amount if there was a substantial, involuntary, permanent, and unanticipated change in circumstances since the last court order and the modification is in the best interest of the child in case of child support and time-sharing, or that such change was not contemplated for at the time of the entry of the original order.
In court you will only be awarded the relief you were able to prove. No matter how many witnesses or documents you have, if you are unable to put them into evidence or overcome objections, they will not do you any good. That’s why it’s important to consult with an attorney early on to help you prepare your case and get the best result possible on the day of trial. Contact Jorge L. Gonzalez, P.A., for personalized legal assistance in this very complicated field of the law.
